Criminal tariffs and fees become billable in isolated and specialty courts

The modernized Legal Aid Alberta Tariff, which came into effect on April 1, 2023, embodies changes in Alberta’s ever-evolving legal landscape.

Tariff items 11.16 (Mental Health Court fee) 11.17 (Indigenous Court fee) and 11.18 (Isolated Court fee) aim to recognize the extra time and attention that go into files appearing in certain specialty courtrooms. They also provide an incentive for roster lawyers to ensure that isolated northern locations are adequately served.

All these tariffs are billable when a file is heard in one of the following courtrooms having a $500 (or 4.0 hour) flat rate.

Mental Health Court Fee – 11.16

Billable in:
• Edmonton Mental Health Court

This list is based on the Alberta Court of Justice Calendar and subject to change as new Mental Health Courts are created.

Indigenous Court Fee – 11.17

Billable in:
• Edmonton Indigenous Court
• Calgary Indigenous Court
• Alexis Nakota Sioux Nation Court
• Siksika Nation Court
• Tsuu T’ina First Nation Court

This list is based on the Alberta Court of Justice Calendar and subject to change as new Indigenous Courts are created.

Isolated Court Fee – 11.18

Billable in:
• Chateh
• Fahler
• Fairview
• Fort Vermilion
• High Level
• High Prairie
• Peace River
• Red Earth Creek
• Slave Lake
• Wabasca-Desmarais

This list is subject to change per LAA discretion and may include updated locations. It is also important to note that this tariff item operates independently of LAA’s Travel Policy and is billable in these locations regardless of whether or not travel is granted.
