Family, Child Welfare and Family Violence
An Act respecting First Nations, Inuit and Métis children, youth and families
A lawyer can help ensure that your rights or your child’s rights are protected under Canadian law in family or child welfare matters.
There is a federal law called “An Act Respecting First Nations, Inuit and Métis children, youth and families.”
This law requires the court to prioritize a child’s cultural, linguistic and spiritual connection to their Indigenous heritage. Your Nation or Indigenous community is part of the circle of support for your child and can be involved to support the family where possible. The law states that no child should be removed from their home solely because of poverty or a lack of housing. When facing criminal charges, a healing plan can be developed that involves the family rather than just the individual. If you have any concerns about your family, be sure to share them with your lawyer.
