As a general rule, Legal Aid does not cover Traffic Safety Act (TSA) charges.
There are, of course, some very limited exceptions. A client can be determined to be in jeopardy if the offence of which they are accused carries a specified sentence of jail, such as second conviction under s 94(2) within a year, which carries a specified penalty of 15 days in jail.
It is worth noting that “pay or stay” tickets, those being tickets for which a fine is the actual sentence, but time in custody will be imposed if the fine is not paid, does not qualify as being in jeopardy for the purposes of obtaining coverage through LAA.
With this in mind, 11.08 is not to be billed for TSA charges unless those charges are explicitly included on the certificate. While counsel may find it practical to resolve TSA and other provincial offences at the same time as criminal charges, these are not billable if they are not covered by the certificate.
