How to get coverage for an existing client’s new charges
When an existing Legal Aid Alberta client has new Criminal charges, the process for requesting coverage depends on the charge(s). Using the correct process helps avoid delays and unnecessary work for counsel.
New legal issues | How to request coverage | Notes |
Information containing only section 145 breaches of conditions — except s. 145(1) CC | Authorization Request through Lawyer Portal | Submit an Authorization Request on the existing Certificate and select Add Legal Issue. Multiple Informations can be included in one request; a separate request is not required for each Information. |
All other new substantive charges, including:
| Client Gateway | These legal issues cannot be added to an existing Certificate. A new Certificate is required. The client can apply by phoning LAA or counsel can assist them by submitting a Client Gateway form. |
Important reminder before starting work
Legal Aid Alberta strongly recommends that counsel not begin work on a new legal issue before coverage is approved. Counsel will not be permitted to bill for work performed without coverage, and coverage is not granted retroactively. Because LAA services are not free, the client must consent to any new certificate before coverage can be issued.
