What many Albertans may not realize is that much of Legal Aid Alberta’s work is delivered through a network of private lawyers who take legal aid files in addition to their regular practice. Paul Welke, roster relations management lawyer, explains how the roster program works and why it’s essential to access to justice across Alberta.
Many Albertans are familiar with Legal Aid Alberta but may not know what the roster program is. Can you explain it?
Legal Aid Alberta operates a hybrid model using a combination of staff lawyers that work for LAA themselves and private lawyers who work for their own firms but take on legal aid files in addition to their private practice.
When someone qualifies for legal aid, they are being connected with qualified lawyers who have been approved to take legal aid files. Clients can choose who represents them, and many roster lawyers are well-established practitioners in their communities. The roster program helps ensure Albertans can access the legal representation they need, regardless of where they live or their financial circumstances.
What types of lawyers are on the roster and how do they help provide access to justice, especially for clients who can’t afford it?
Roster lawyers provide legal services in several areas of law, including criminal defence, family law and immigration matters. They work in private practice while also taking legal aid files, helping eligible Albertans access legal representation when they might otherwise be unable to afford it.
What’s the process for private sector lawyers to join the program?
Lawyers who want to join the roster must complete an application process and demonstrate experience in the areas of law in which they wish to practise. Applications are reviewed by a selection committee to make sure that we are getting the right lawyers to do the right things for Legal Aid Alberta and our clients.
How does Legal Aid Alberta ensure high-quality representation for clients?
A thing that surprises a lot of people is that they assume from watching American television, that if you’re getting a lawyer through legal aid, you’re getting a lower quality, bargain basement type. But that’s not the case. In fact, a lot of lawyers you see taking these large cases that hit the news are also on our roster and can be requested by clients. The roster program isn’t about providing a different level of service. It’s about making quality legal representation accessible to people who otherwise might not be able to afford it.
How does the roster program help provide access to justice across Alberta?
The roster program allows us to connect clients with lawyers throughout the province, including in communities where Legal Aid Alberta may not have a staff office. By partnering with lawyers in places like Peace River, Brooks and other communities throughout Alberta, Legal Aid Alberta can connect eligible clients with legal representation closer to home.
