November 2, 2021 – Many of you will have started receiving reminders from the Alberta Lawyers’ Indemnity Association (ALIA) to pay a Civil Litigation Filing Levy on certain matters in the Court of Queen’s Bench. Most actions funded by Legal Aid Alberta fall outside the scope of this new levy, since criminal and family matters are not covered.
In rare cases where a matter might be captured by the levy – such as an application under the Adult Guardianship and Trusteeship Act or the Mental Health Act – ALIA provides an exemption from the levy for “commencing or responding to an action by a party funded by Legal Aid Alberta.”
