A: A settlement is not supposed to punish the person or organization that discriminated against you; instead, it is supposed to put you in the place you would have been if the discrimination hadn’t happened.

 

The CHRC will help you reach a settlement aimed at:

  • preventing the discrimination in the future; and
  • recovering the losses you suffered as a result of the discrimination.

 

Examples of possible settlements include requiring the respondent to:

  • provide an apology;
  • provide training;
  • commit not to continue the discriminating behaviour;
  • reinstate you to your former job;
  • give you financial compensation (money) for lost wages or pain and suffering;
  • attend education sessions; or
  • put certain policies in place.

 

You are responsible to mitigate your damages.  That means you have a responsibility to make sure your losses don’t add up where you can take steps to reduce them.  For example, if you are fired, you have a responsibility to find a new job.
